April 10, 2019 Meeting Minutes

Chairman Bill Burlingame called the meeting of the Town Board of Koshkonong to order at 7:00pm. The clerk verified the proper notices had been posted.

Chairman Bill Burlingame, Supervisor Jim Brandenburg, Supervisor Walt Christensen, Supervisor Stacy Kutz, Supervisor George Jaeckel, Treasurer Caitlin Kincannon and Clerk Kim Cheney present.

Brandenburg/Jaeckel motion to suspend the agenda to allow Sheriff Paul Milbrath to address the board. Motion carried.

The chairman asked the sheriff to talk about road closures during times of high water. The sheriff indicated the Town has the authority to close roads at their discretion. He advised the Town to develop a consistent policy for such closures. The sheriff’s department will enforce the road closures with the proper/legal signage. The sheriff also announced that a convicted sex offender would be returning to the Kutz Road residence in the very near future. The Town will receive notice

Christensen/Brandenburg motion to return to the agenda. Motion carried.

Public Comments limited to agenda items, 3 minutes maximum. No other audience comment allowed during agenda items.

Steve Borchardt, W7233 River Trail Pass, spoke of the status of the Home Owners Association for the Twin Knolls subdivision. He indicated there is no HOA and that the DNR had looked at the outlots in the subdivision and advised on the maintenance of the lots.

Jim Bauer, owner Island Bar (Town of Sumner) on Blackhawk Island Road. Spoke on the subject of road closures during high water. He wants the board to consider all aspects when deciding to close the road, as his customers need to drive through the Town of Koshkonong to get to his business.

Toni Whtley – County Road N. Owner of the antiques business seeking rezoning and a conditional use permit. Indicated they are a thriving business and hopes the board will consider their requests favorably.

Brian – Rock River Bait Box. Asked the board to find parameters that work for businesses/residents when closing roads due to high water.

Approve March meeting minutes.

Supervisor Kutz indicated a correction in the minutes. Kutz/Christensen motion to place the minutes on file as corrected. Motion carried.

Treasurer’s Report

Treasurer Kincannon presented the March monthly financial report. Kutz/Jaeckel motion to place the March report on file. Motion carried.

Discuss/Action of Road Agreement with Enbridge.

Enbridge unable to attend due to weather. This will be on the May agenda.

Discuss/Action of request for Brian and Brenda Lintvedt to combine two certified survey map lots to create one lot so an auxiliary structure may be constructed on prior Lot #1 at 016-0513-2543-010 & 011.

Brian Lintvedt present. From Supervisor Kutz, this is a consolidation of two parcels to allow an outbuilding. The Plan Commission had no concerns and recommended approval. Kutz/Jaeckel motion to approve the request to combine the parcels, motion carried.

Discuss/Action of request for Brian and Brenda Lintvedt for a variance to use the existing driveway he constructed for an auxiliary structure at 016-0513-2543-010

Driveway already there, two parcels were combined. Jaeckel/Brandenburg motion to allow the second driveway, motion carried.

Discuss/Action of request for Daniel and Toni Whitley to create a .382-acre, A-2 zone for a small business to sell antiques and handmade crafts to supplement the owners retirement at Parcel #016- 0514-0112-002 and conditional use permit for antiques business.

Daniel & Toni Whitley present. They have owned the property for almost two years. They originally thought the property was zoned commercial. Concerns regarding parking. The Whitley’s have proposed procedures to accommodate overflow parking. They will also put up signs for no parking on CTH N. Kutz/Jaeckel motion to approve the rezone request from A3 to A2, motion carried. Kutz/Jaeckel motion to approve the conditional use request, motion carried.

Discuss/Action of request for Chrissy Gaggioli (petitioner) for a preliminary certified survey to amend zoning from A-T to Business to allow a restaurant at N416 Twinkling Star Road.

Gaggioli’s present. They are purchasing this property and wish to open as bar/restaurant. From Supervisor Kutz no concerns from the Plan Commission. This is at the request of the county to bring the property into compliance with county zoning. Kutz/Brandenburg motion to approve the rezone request from AT to Business, motion carried.

Discuss/Action of request for Chrissy Gaggioli (petitioner) for a conditional use permit to allow a restaurant at N416 Twinkling Star Road.

Kutz/Jaeckel motion to approve the conditional use request, motion carried.

Discussion of Transient Merchant Permit application for Sam O’Reilly of Sidex Corp of WI.

Sam O’Reilly present to request a permit to sell windows, siding and tubs/shower door to door in town subdivisions. He estimates approximately 2 days for the week of April 15th. Christensen/Kutz motion to approve the permit request at a fee of $80, not to exceed 3 days during the week of April 15th. Motion carried.

Discussion of Home Owners Association status for the Twin Knolls Subdivision.

Several residents present. They are opposed to forming the association. Per the clerk and chairman’s discussion with Attorney Bill Cole. Under sections of the original developers agreement the town could force the residents to form an association but the town does not want to have a legal battle at a cost to the residents. The town is under no obligation to maintain the outlots. If they should fail the town could step in and provide maintenance at a cost to the residents to be attached to property tax bills.

The residents will come up with their own plan for the outlots based on advisement from the DNR etc.

Discuss/Action of appointment of Plan Commission members for new terms.

Kutz/Jaeckel motion to appoint Carol Clavey as chairperson, Jae Ames as Commission and Linda Bruss as an alternate to the Plan Commission for 3 year terms. Motion carried.

Kutz/Jaeckel motion to suspend the agenda to allow present residents to seek their requests. Motion carried.

Discuss/Action second driveway request at N1394 Schwemmer Lane

Dan & Melanie Dunkelburger present. They would like a second driveway to their shed. This is in a cul de sac. Jaeckel/Christensen motion to approve the request for a second driveway with a permit. Motion carried.

Discussion only of Closing Town Roads

Suggested to follow county parameters when closing roads due to high water. Kutz will research. The clerk will check with other towns to see if they have written policies/procedures. This will be on the May agenda.

Kutz/Brandenburg motion to return to the agenda. Motion carried.

Discuss/Action of 2019 Road Bids

Public Works superintendent Dan Butz has asked Payne & Dolan and Scott Construction to look at roads. He advised there will be a significant materials increase this year. Wedge and sealcoat method discussed. Bids should include road prep. Roads to bid: Twinkling Star, Hoge, Star School, Woodlawn and Smiley. Public works will work with the clerk’s office to prepare the bids.

Discuss/Action of 2019-2020 Salt Contract

Current inventory less than 50 tons. Expecting late season delivery from last contract. Brandenburg/Christensen motion to order 300 tons on early fill and 100 tons seasonal fill. Motion carried.

Discuss/Action of Campground and Mobile Home Park Ordinance draft.

Kutz/Jaeckel motion to table this to the May meeting. Motion carried.

Discussion only of Parking in Subdivisions

Several requests received from residents in the Apple, Thornapple, Maxwell area to allow parking on one side of the road, off the pavement for summer only. No parking on roadways in the winter. Public works will put up the signs.

Discussion only of Road Funding

Suggested to borrow money to fund road projects. Supervisor Brandenburg compiled a list of roads that need to be sealcoated on newer pavement. He feels it is important to take care of these roads that have newer pavement to extend their life use. The chairman spoke with Premier Bank, current interest rates are 2.18 to 2.3% for a 5 year term and 2.45 to 2.6% for a 10 year term. Public works will get some sealcoat estimates.

Discuss/Action of Clerk’s Contract

Brandenburg/Jaeckel motion to approve the presented contract for a two year term and annual salary of $25,000 each year. Motion carried.

Clerk’s Report

Fort Atkinson ambulance committee meeting on Monday April 15. Supervisor Christensen will attend. Fort Atkinson fire department meeting on Thursday April 18 at 2pm to discuss draft contract with the 5 rural towns. Chairman Burlingame and Clerk Cheney will attend.

Public Comment

Resident Greg Wellach of Rock River Road presented a petition asking the Town to consider making Rock River Road and Bark River Road a dead end to eliminate the road closures due to high water. Concerns include emergency response routes, Rock River Road is designated as a rustic road and Bark River Road is a bike route. This will be on the May agenda.

Also Mr. Wellach voiced his support to borrow money to fund road projects.

Approve bills

Supervisor Brandenburg suggested getting weight tickets from Kyle Franks for sand purchases. Brandenburg/Jaeckel motion to approve the bills, motion carried.
Future agenda items.

Enbridge road agreement, Speed limits on Carnes, Buckingham, Meske, Chesseborough and Cold Spring roads, Campground/Mobile Home ordinance, petition request for dead ends on Bark River and Rock River roads (discussion only) and road construction funding.
