July 20, 2022 Meeting Minutes

Chairman Bill Burlingame called the meeting of the Town Board of Koshkonong to order at 8:04 pm. The clerk verified the proper postings had been made.

Chairman Bill Burlingame, Supervisors Walt Christensen, Jim Brandenburg, Erik Hoffman, Matt Hill, Clerk Bridget Woods and Treasurer Caitlin Kincannon present.

Public comments

Resident Greg Wellach present and spoke about item 4. A constable will help enforce the Town’s ordinances. He further stated that he is opposed to item 7 for a conditional use request to allow 6 dogs as household pets in an R-2 Zone located at N2486 Rock River Road. Stating that the dogs are constantly running at large and are barking most of the day.

Resident Ryan Hitt is also opposed to item 7, states the dogs have poor living conditions.

Resident George Jaeckel spoke regarding item 4, stating this has been on the agenda numerous times. Further, he states that the Town stated a few years ago that a Constable was not going to be pursued. George also noted that item 9 is discussion only again and asked the board to make a decision.

Resident Cheryl Fowler asks for a question regarding ATV use on Town Roads to be put on the November ballot.

Resident Susan Long is in favor of item 11. Regarding item 9, she has concerns of ATV on Town roads. The ordinance needs to be enforced.

Discuss/Action Town Constable

Supervisor Hoffman spoke with the Interim Chief of the Town of Oakland. The process is lengthy. He stated that he has a person that would be willing to be our constable. Constable will not issue speeding tickets. However, the Constable will come to take care of complaints or issues within the Town and enforce our ordinances. Asks for this to be revisited next month.

Supervisor Christensen mentioned that the Town previously had a constable. Chairman Eugene Kapsner of the Town of Oakland stated that it is more cost involved than we will receive in fines. It will be difficult to find a law enforcement officer. He is wary of the concept; because the sheriff can help enforce issues. No action taken.

Discuss/Action approval of Class A liquor license for Tari Poeppel at N1184 Poeppel Road

Supervisors Hoffman/Hill made a motion to approve the Class A liquor license. Motion carried.

Discuss/Action rezone 2 acres of existing R-2 to A-3 located at N2811 Monarch Lane

Chairman Burlingame stated that the resident is no longer going to rezone. No action taken.

Discuss/Action conditional use to allow 6 dogs as household pets in an R-2 zone located at N2486 Rock River Rd.
Resident not present.

Supervisor Brandenburg stated that the board needs to follow up with resident to make sure he has the dogs licensed. He further mentioned that the resident Greg Wellach (present) shares a driveway with this individual.

Supervisor Christensen mentioned living near a residence with many dogs is very disruptive to the neighborhood.

Supervisors Hoffman/Christensen made a motion to deny conditional use request. Motion carried.

Discuss/Action Road work invoice on Poeppel and Cold Spring

Chairman asks that this item be moved down the agenda.

Supervisors Hill/Brandenburg made a motion to move agenda item. Motion carried.

Discussion only: ATV/RTV/UTV Ordinance

Supervisor Hoffman is in favor of opening all the roads, except for subdivisions to create a rule for a direct path for in and out access only.

Supervisor Hill make a rule that ATV operators take the most direct path in and out of the subdivision.

Supervisor Brandenburg stressed that ATV operators within a subdivision must take the most direct route in and out of the subdivision. They may not ride within the subdivision.

Chairman Burlingame asks the board if they would consider that if the residents within a subdivision can decide if they would allow riding within their neighborhood.

Supervisor Hill suggests that each subdivision should be able to decide to opt out of the direct path in and out and have the whole subdivision open to ATVs.

Noah T Rusch, Axley Attorneys mentioned that a part of the ordinance can state that each subdivision can decide whether or not they want ATVs operating within their neighborhood.

Chairman Burlingame suggests to note in the ordinance no repeated passes.

Supervisor Brandenburg suggests to open South Main east to Hwy 12, Endl east to Hwy 12, Poeppel to business 26. Riders need to take the shortest route out of the subdivision.

Supervisor Hoffman states that the simple majority will rule on the decision of the neighborhood. He further stated to move this to next month’s meeting as discuss/action.

Discuss/Action Shop Building funding

Per Public Works Superintendent, $298.344 was the approved amount.

Supervisors Hoffman/Brandenburg made a motion to research funds for completion of the shop building. Motion carried.

Discuss/Action Amend Driveway ordinance to remove 3 ft concrete restriction

Supervisors Hoffman/Christensen made a motion to remove the 3ft concrete restriction. Motion carried.

Discuss/Action change August meeting date to August 17th

Supervisors Brandenburg/Hoffman made a motion to move the August 10th meeting from August 10th to August 17th. Motion carried.

Discuss/Action Text Amendment to comply with CH 91 per DATCP findings.

Supervisors Christensen/Brandenburg made a motion to approve the Text Amendment from Jefferson County as presented. Motion carried.

Discuss/Action Road work invoice on Poeppel and Cold Spring.

Supervisors Brandenburg/Christensen made a motion to issue Rock Road the final payment for Cold Spring and Poeppel Road. Motion carried.

Approve meeting minutes from June 9, 2022

Supervisors Hill/Hoffman made a motion to approve June 9 minutes. Motion carried.

Treasurer’s Report

Supervisors Brandenburg/Hill made a motion to place Treasurer’s report on file. Motion carried.

Approve Bills

Public Works Superintendent Dan Butz asks to exclude Fahrner payment from bills to be paid. Supervisors Hoffman/Brandenburg made a motion to pay the bills. Motion carried

Supervisor Brandenburg/Hill made a motion amend previous motion to exclude Fahrner from the bills until the culvert issue has been resolved. Motion carried.

Clerk’s Report

Clerk Woods mentioned upcoming conference WMCA August 24 and 25 that she would like to attend. WTA unit meeting is July 26 in Ixonia. She also said that the permit for the bathroom at the park has been received and is in her office.

Public comment-no discussion

Supervisor Christensen give update on the park bathroom. Explained the installment process and stated that the funds are from Capitol expenses.

Supervisor Christensen asked that a line item for announcements be placed on the agenda.

Chad Hilstad, concerned about the developments on Koshkonong Mounds Road. Expresses concern about the water supply due to the number of buildings being built.

Dan Butz suggests that the board makes the ATV use on town roads simple. Riders may get confused.

Supervisor Brandenburg asked about IT support and website issue.
Chairman Burlingame mentioned that the website issue is currently being worked on.

Supervisor Christensen mentioned the Town should look into the grant for broadband. Jefferson County has received a large grant to put in fiber optic where they can and will install towers in rural areas.
