Chairman Bill Burlingame called the meeting of the Town Board of Koshkonong Township to order at 6:00 pm. The clerk verified the proper postings had been made.
Chairman Bill Burlingame, Supervisors Walt Christensen, Jim Brandenburg, Erik Hoffman, Matt Hill. Clerk Bridget Woods, Administrative Assistant Kim Cheney and Treasurer Caitlin Kincannon present.
Tom Patterson, Patterson Builders LLC; Todd Needham, Batterman Engineers; William Cole, Town Attorney; Tim Hayes, Town Engineer were in attendance. List of residents in attendance are listed at the end of the minutes.Discuss/Action Koshkonong Lake Estates Developer’s Agreement/ordinances/permits.Town Engineer, Tim Hayes reviewed grading elevations and concerns regarding drainage issues. He identified several areas of concern on current built or under construction properties. The concerns included grading elevations, ditching and drainage swales.
Todd Needham of Batterman requested CSV files of the Town Engineer’s findings.
There was a discussion regarding culverts and roadside ditches. It was decided that the responsibility of cleaning the culverts is the property owner or the developer. The Town agreed to clean the culverts at the developer’s expense.
Chairman Burlingame questioned the Town Attorney, William Cole regarding the Town’s liability for any deviations from the Developer’s Agreement and grading plan. Attorney Cole stated that any deviations from the plan must be given in writing by the developer. Any deviations from the plan without written notice is a violation of the developer’s agreement.
Chairman Burlingame strongly encouraged property owners to read the Developer’s Agreement and the Covenants and Restrictions.
Also, he requested to the developer to create a Home Owners Association. Tom Patterson states that one is in process.
The Town requested that the property owners obtain driveway permits, and not the developer.
Mr. Patterson agreed to remove unpermitted access and culvert.
An agreement was made that Patterson Builders, LLC will hire Town Engineer, Tim Hayes to shoot grades prior to any construction of lots. Batterman will create plans for each individual building project and submit it to the Town Engineer for approval on a lot-by-lot basis.
Attorney Cole suggests that the Town should have a discussion on how to proceed with the existing grading issues. Town Engineer Tim Hayes will look at each lot to ensure proper water shed.
Public Comments
Property owner Susan long expressed concern about the Home Owner’s Association would be unfair if not all the property owners take part in its creation.
Chairman Burlingame asked who is responsible to water shed control. Per Attorney Cole, it is maintained through the Covenant and Restrictions document.
Property owner Craig Long expressed concerns of lot line encroachment for swale construction. Mr. Patterson agreed to speak with individual property owners regarding encroachment issues.
Dusty Behlke expressed concern of the tree line on Old 26 Road will impede water flow on the East side of the development.
Property Owner Susan Long mentioned that all of the meetings delay building and will most likely increase cost to the property owners.
AdjournmentSupervisors Brandenburg/Hill made a motion to adjourn at 8:18 pm. Motion carried.
